@musictechpolicy: Facebook’s Music Licenses: What’s Not to Like?

Facebook pays no royalties for the music that gives significant value to the platform. That’s often a surprising proposition for artists and songwriters, much less the general public.

Yet it is true—hitmakers and new artists, pros and amateurs alike do not get a penny from Facebook and the company doesn’t even attempt to license their work. Why should a multibillion dollar multinational corporation that anchors a large piece of the Internet economy and whose founder is planning on running for President of the United States get to pay music makers in exposure bucks?

The answer is that Facebook, like YouTube and many other user-generated content platforms hide behind the legacy DMCA “safe harbor” and its nonnegotiable, unconscionable, adhesion contract that controls the use of its platform.

Rumor has it that Facebook is evidently coming to the table and is in at least semi-active negotiations with at least some labels and publishers.

One may well ask what took so long—but if it were not for Universal Music Group’s pursuit of Facebook’s infringements through DMCA notices, it’s likely that Facebook would be blithely rolling on its monopolist juggernaut.

On the other hand, this is actually a good time to be negotiating these deals give the Congressional scrutiny of Facebook’s involvement in the 2016 Presidential election campaigns. We have the benefit of public statements by Facebook representatives under oath regarding what they can do and what they so far refuse to do which may come in handy in licensing negotiations.

These negotiations with rights owners may result in what will seem like a very big pop of up-front cash—but is it? And whatever the number, how will that money be distributed to the artists and songwriters that make it happen?

This MusicTechPolicy.com post from April 28, 2013 may be worth reviewing given the news that Lessig is about to take over the Icelandic government through his Pirate Party vehicle. The latest Wikileaks release shows the contempt in which Lessig is held by leading progressives and the Clinton Campaign (not to mention Lessig pal Zephyr Teachout) and how quickly they are scampering to publicly embrace him, which of course feeds his ego beyond category.

If the Obama Administration wants to lame duck their way out of amending (or terminating) these ancient consent decrees, they could at least do songwriters the courtesy of requiring their revolving door appointees to tell songwriters to their faces at a public hearing before the Senate Judiciary Committee. Instead, the Administration encouraged songwriters to wrack their brains on ways to improve the ancient rules, then pulled the rug out in favor of what Rep. Collins called “arrogance at its worst.”

An Insult to the Heart: Lobbyists Organize Big Tech Rallies in Europe

The ghost of Edward Bernays walks the streets of the ancient capitols of Europe.  As the man who wrote the book on propaganda (literally) Bernays made a chilling observation:

The conscious and intelligent manipulation of the organized habits and opinions of the masses is an important element in democratic society. Those who manipulate this unseen mechanism of society constitute an invisible government which is the true ruling power of our country. …We are governed, our minds are molded, our tastes formed, our ideas suggested, largely by men we have never heard of.

In a post-Cambridge Analytica world, the battle for humanity will be fought over the equivocation of “freedom”—the basic human freedom of expression will be coopted by the corporate freedom from regulation to profit from surveillance by machines.  It is the ad-man’s old challenge–make you think something that will kill you is actually good for you.

In turning the machines loose on the humans who are their product, corporations will use tools that Bernays foreshadowed–but these “men we have never heard of” will be playing with the very foundations of democratic institutions of the nation state.  Who wins this battle is up for grabs right now and nowhere are we seeing this struggle for humanity more clearly rendered than in Europe in the battle over Article 13.

In almost every act of our daily lives, whether in the sphere of politics or business, in our social conduct or our ethical thinking, we are dominated by the relatively small number of persons…who understand the mental processes and social patterns of the masses. It is they who pull the wires which control the public mind.

We should understand that the “value gap” that sparked this extraordinary lobbying effort by American multinational corporations to bring Europe to heel was symptomatic of a more fundamental sickness.  That commercial symptom could, and perhaps should, be more readily understood as a “values gap”–the perverse voyeurism of the surveillance capitalists to commoditize all that touched their networks and use artists to lure the humans whose data could be scraped, whose behavior could be monitored and eventually manipulated for even greater profit.

I’d suggest that is why this struggle in Europe resonates so deeply with artists around the world.  It’s not just the commercial insult.  It’s not the metaphorical Room 101 app where the winning answer is 2+2=5.

It is an insult to humanity.  It is an insult to the heart.
